Rückerstattungsrichtlinie

HostClaim bietet eine 14-tägige Geld-zurück-Garantie auf jeden Kauf: Pay-Per-Claim-Freischaltungen, Schadensfall-Mehrbeträge, Widerspruchszugang, 30-Tage-Daten-Download-Zugang, Host-Abonnements und Operator-Abonnements. Rückerstattungen werden automatisch innerhalb von 14 Tagen nach dem Kauf bearbeitet — ohne Begründung, ohne Fragen. Die Rückerstattung erfolgt über Stripe auf Ihre ursprüngliche Zahlungsmethode. Bei einer Rückerstattung wird der mit Ihrem Kauf verbundene bezahlte Zugang entfernt: Schadensfall-Freischaltungen werden in den Entwurfsstatus zurückgesetzt, Widerspruchszugang wird entfernt, Download-Zugang wird widerrufen. Bei Abonnements wird das Abonnement sofort gekündigt und der Zugang endet am Tag der Rückerstattung. Nach 14 Tagen liegen Rückerstattungen im Ermessen von HostClaim und sind nicht garantiert. HostClaim helps users organize and document damage claims for submission to Airbnb and VRBO. HostClaim does not provide legal advice, does not act as your representative, and does not guarantee claim outcomes. Use of this platform does not create an attorney-client relationship of any kind.

2. Language of Agreement

These Terms of Service are provided in English only. By creating an account and using HostClaim, you confirm that you have sufficient understanding of English to read and agree to these Terms. HostClaim is not responsible for any misunderstanding arising from language differences.

3. No Warranty of Accuracy

Platform deadlines, filing rules, and wizard steps are provided for informational purposes only and may not reflect the most current policies of Airbnb or VRBO. Platform rules change without notice. Always verify deadlines and requirements directly with Airbnb or VRBO before filing.

4. No Liability for Missed Notifications

HostClaim is not responsible for missed deadlines resulting from iCal sync delays, cron errors, email delivery failures, notification failures, or any other technical issue. You are solely responsible for knowing and meeting all applicable filing deadlines.

5. No Liability for Claim Outcomes

HostClaim makes no guarantee that using the platform will result in approval, reimbursement, or any other outcome on any claim. Claim strength scores and indicators displayed within the platform reflect documentation completeness only — they are not predictions of approval or reimbursement by Airbnb, VRBO, or any other party.

6. Host Responsibility for Communications

Any messages, communications, or documents generated by HostClaim and sent to guests or third parties are sent solely at your direction and under your authority. You are solely responsible for the content, accuracy, and consequences of all communications you send using or based on HostClaim-generated content. Appstack, LLC bears no responsibility for any claim, dispute, or liability arising from guest communications.

7. Limitation of Liability

In no event shall Appstack, LLC's total liability to you exceed the total fees paid by you to Appstack, LLC in the 12 months preceding the event giving rise to the claim. Appstack, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any kind. Some jurisdictions do not allow the exclusion of certain damages — in such cases, these limitations apply to the fullest extent permitted by applicable local law.

8. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Appstack, LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses — including reasonable legal fees — arising out of or in any way connected with your use of HostClaim, your communications with guests or third parties, your violation of these Terms, or any claim brought by a guest or third party related to a damage claim you filed. This provision does not apply where prohibited by mandatory consumer protection law in your jurisdiction.

9. Acceptance of Terms

By creating an account and using HostClaim, you confirm that you have read, understood, and agreed to these Terms of Service. Your continued use of the platform constitutes ongoing acceptance of these Terms as updated from time to time.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in North Carolina, except where mandatory applicable law in your country of residence requires otherwise. If you are located in the European Union, European Economic Area, or another jurisdiction with mandatory consumer protection laws, nothing in these Terms limits rights you are entitled to under applicable local law.

11. Severability

If any provision of these Terms is found to be unenforceable in any jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remainder of these Terms continues in full force and effect.
